All Importers, Exporters, Traders, Freight Forwarders, Declaring Agents, Cargo Agents, and Carriers of controlled substances listed in the Third Schedule of the Misuse of Drugs Act (MDA) 1973.
Scheduled substances controlled by Director, Central Narcotics Bureau (CNB)
CNB is the approving authority for controlled substances listed in the Third Schedule of the MDA 1973 since 5 September 1999. A circular dated 31 August 1999, which includes a list of the controlled substances, had been previously circulated to all traders. For ease of reference, the updated controlled substances list with effect from 1 June 2022 is enclosed at ANNEX A.
With effect from 1 June 2022, the following substances have been included in Part 1 of the Third Schedule of the MDA 1973:
Methyl alpha-phenyl acetoacetate (also known as MAPA),
N-Phenylpiperidin-4-amine (also known as 4-anilinopiperidine, N-phenyl-4-piperidinamine or 4-AP),
tert-Butyl 4-(phenylamino)piperidine-1-carboxylate (also known as 4-anilino-1-boc-piperidine, 1-boc-4-anilinopiperidine, tert-butoxycarbonyl-4-anilinopiperidine, t-boc-4-anilinopiperidine, t-boc-4-AP, 1-boc-4-AP or boc-4-AP), and
N-phenyl-N-(piperidin-4-yl)propionamide (also known as nor fentanyl)
With this inclusion, the manufacture, supply, possession, import or export of the newly added substances to the Third Schedule of the MDA 1973 as stated in para 2 above, for the purpose of manufacturing of a controlled drug, would contravene Section 10A of the MDA 1973. Any person convicted of this offence shall be punished with imprisonment not exceeding 20 years or with a fine not exceeding S$200,000 or with both. Persons found to have imported or exported this substance without a permit from CNB can be prosecuted under Misuse of Drugs (Controlled Equipment, Material and Substances) Regulations and punishable with imprisonment not exceeding 3 years or with a fine not exceeding S$10,000 or with both.
With effect from 1 June 2022, traders intending to import, export or transship the newly added substances to the Third Schedule of the MDA 1973 as stated in para 2 above, shall make a declaration of its intent to do so to CNB, 14 days before the effective date of import, export or transshipment.
CNB is the approving authority for the import, export and transship of the newly added substances to the Third Schedule of the MDA 1973 stated in para 2 above. They are currently declared under HS codes as 29183000 or 29333990, depending on the product descriptions.
With effect from 5 November 2015, in addition to HS codes, traders and declaring agents are required to indicate “CNB” as the approving authority under the Customs Procedure Code (CPC) field in your permit application submitted in TradeNet®.
The new requirement for CPC is introduced to facilitate the processing of your import/export/transshipment permit applications submitted for products that contain CNB controlled substances but are not classified under CNB controlled HS codes.
